Alessandro's ( EEA NATIONAL) right to work

16/04/2021

Alessandro is one of our service users, an Italian citizen who has been living in the UK for 21 years. In early October 2020, he applied to work as a Warehouse Operative through a recruitment agency company. After he signed his contract, the recruitment agency performed his right-to-work check. Sadly, the company did not allow Alessandro to work because he did not have a Biometric Residence Card. He explained to his employer that he did not need one because his EU national Identification document was good enough to prove his right to work. He said, " The Home Office has accepted my ID; why do you not accept it? " Unfortunately, they refused and told him that the Home Office has nothing to do with the right to work.
Alessandro contacted the Home Office and explained the situation. They were surprised and said that his employer should have accepted his EU national ID, and there was no need for him to prove his EU settlement status during the ' grace period.'  EEA citizens' rights are not protected in practice at work.
After he verified his immigration status, he sent his 'share code' to the manager. (In the absence of any physical documents, the' share code' is the only way for over 3 million EEA nationals to prove their right to work to employers, after 30th June 2021.) The following day, Alessandro received an email stating, "as no further documents were supplied, your application will not proceed further" application."
Hang on a minute! He has a contract and supplied two types of documents, his valid EU ID and EU settlement status. On 17th June 2021, we will be in Court to challenge his employer, the biggest recruitment agency in the UK, so that other EEA nationals do not have to go through a similar situation after the transition period. Sadly, since then, Alessandro has been sick and finds it extremely challenging to support his two children, born and raised in the UK.
He told us that he was considering selling his car. If he does that, he will not be able to move around in his condition. Alessandro's legal representation is covered. Unfortunately, he needs some financial assistance. We are raising funds to support. Any funds received will be sent to him.
